1. Acceptance of these terms

By creating a Gleampses account or by using the Gleampses platform, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use Gleampses. These Terms constitute a legally binding agreement between you and Michelangelo Gubinelli ("Operator", "we", "us").

2. Eligibility

You must be at least 14 years old to use Gleampses. By registering, you warrant that you are at least 14 years old. If you are under 18 years of age, you represent that you have obtained consent from your parent or legal guardian to use Gleampses and that your parent or guardian has read and agreed to these Terms on your behalf.

If you are under 14 years of age, you may not create an account or use Gleampses. If we become aware that an account belongs to a person under 14, we will delete that account without notice.

3. What Gleampses is

Gleampses is a location-based social platform that allows users to drop geographic pins and attach lightweight artifacts (text, links, images, or audio) to those pins. Gleampses is a passive platform — we do not moderate, review, or endorse user content before it is posted.

Gleampses is provided by Michelangelo Gubinelli, an individual operating without a formal business entity at this time.

4. Your account obligations

When using Gleampses, you agree to:

• Provide accurate and complete information when creating your account.
• Keep your account credentials confidential and not share them with anyone.
• Not use another user's account without their express permission.
• Notify us immediately of any unauthorised use of your account at info@gleampses.com
• Use Gleampses only for lawful purposes and in accordance with these Terms.

5. Prohibited content and conduct

You may NOT use Gleampses to create, post, or share content that:

• Is unlawful, threatening, harassing, defamatory, or abusive.
• Infringes on the intellectual property rights, privacy rights, or any other right of any third party.
• Discloses another person's precise geographic location without their consent ("doxxing").
• Contains sexually explicit material, violence, or hate speech.
• Depicts minors in any sexual or exploitative context.
• Is spam, advertising, or commercial solicitation.
• Introduces malware, viruses, or any code designed to disrupt, damage, or limit the functionality of Gleampses.
• Attempts to access accounts, pins, or data belonging to other users.

Violation of this section may result in immediate suspension or deletion of your account, at our sole discretion.

6. Interactions between users — no liability

Michelangelo Gubinelli and Gleampses are not liable for any harm, harassment, threats, assault, defamation, privacy violations, or any other unlawful conduct committed by one user against another.

Gleampses is a platform provider only. We do not employ moderators who review user-generated content before it is posted. We are not a party to any interaction between users and have no control over the content users choose to share.

If you experience or witness conduct that you believe is unlawful, you may report it by emailing info@gleampses.com. We will review reports and may remove content or terminate accounts at our discretion. We do not guarantee a particular response time or outcome.

Users are solely responsible for their own conduct and their interactions with other users. You release Michelangelo Gubinelli from any and all claims arising from your interactions with other users.

7. Intellectual property

You retain all intellectual property rights in the content you create on Gleampses (pins, artifacts, diary titles, and any text or links you post).

By posting content on Gleampses, you grant Michelangelo Gubinelli a non-exclusive, royalty-free, worldwide, sublicensable license to store, reproduce, display, and transmit your content solely to the extent necessary to provide the Gleampses service to you and other authorised users.

The Gleampses name, logo, and design are the intellectual property of Michelangelo Gubinelli. You may not use them without prior written permission.

8. Account deletion and data removal

You may delete your account at any time through the account deletion feature in your account settings, or by emailing info@gleampses.com. Upon deletion, your account, profile, pins, artifacts, friendships, and diaries will be permanently and irreversibly removed from Gleampses within 30 days.

Content you have shared with other users (e.g., in shared diaries or before making a pin public) may persist in those other users' accounts after your deletion, as we cannot control content that has already been reproduced by other users.

9. Service availability

We endeavour to keep Gleampses available 24 hours a day, 7 days a week. However, we do not guarantee uninterrupted access. Scheduled maintenance, updates, or factors outside our control (such as third-party infrastructure failures) may result in temporary unavailability.

We reserve the right to modify, suspend, or discontinue Gleampses at any time, with or without notice. If we discontinue Gleampses, we will provide reasonable notice where possible and will delete your account data upon your request.

10. Indemnification

You agree to indemnify, defend, and hold harmless Michelangelo Gubinelli from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your violation of these Terms.
• Your use of Gleampses in a manner not permitted by law.
• Content you post on Gleampses that infringes the rights of any third party.
• Your violation of any applicable law or regulation.

11. Limitation of liability

To the maximum extent permitted by applicable law, Michelangelo Gubinelli shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of Gleampses, whether based on contract, tort, strict liability, or any other legal theory, even if advised of the possibility of such damages.

Michelangelo Gubinelli's total aggregate liability arising out of or in connection with Gleampses shall not exceed the amount of EUR 100 (one hundred euros) or the total fees paid by you to Gleampses in the 12 months preceding the claim, whichever is greater.

This limitation does not apply to liability that cannot be excluded or limited under applicable law, including Italian law as applied to consumers under D.Lgs. 206/2005 (Consumer Code).

12. Disclaimer

Gleampses is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that Gleampses will be error-free, secure, or uninterrupted, or that any defects will be corrected. Use of Gleampses is at your own risk.

13. Governing law and jurisdiction

These Terms are governed by and construed in accordance with Italian law. Any dispute arising out of or in connection with these Terms, including disputes about their existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts of Italy, unless mandatory consumer protection rules under your national law require otherwise.

If you are a consumer habitually resident in an EU member state, you also benefit from any mandatory provisions of the law of your country of residence that cannot be derogated from by agreement (Art. 6(2) Rome I Regulation — EU Regulation 593/2009).

14. Modifications to these terms

We may modify these Terms from time to time. The "Last updated" date at the top of this page reflects the date of the most recent version. Material changes will be communicated via the email address associated with your account or by a notice in the application. Your continued use of Gleampses after such notice constitutes your acceptance of the modified Terms.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving the parties' original intent. If no such modification is possible, that provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect.

16. Entire agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Michelangelo Gubinelli with respect to Gleampses and supersede all prior or contemporaneous understandings, representations, or agreements, whether oral or written.
